When people go through a divorce, it is one of the most distressing times of their life. A divorce can be emotionally as well as economically damaging for you. It is natural to feel alone and want to have someone you can share your heart with during these times. This is why many people start dating before their divorce is even finalized.

While it is natural to become lonely and eager for a romantic partner during a divorce, it is essential to understand the consequences. Dating can have a negative influence on your divorce case. An Alabama divorce attorney can help you understand the risks and how to avoid them.

How does dating affect your divorce case?

Here are some ways dating can negatively impact your divorce case in Alabama. However, it may not be the same for everyone.

    • Your spouse may file a dissipation case against you.

One of the most significant risks associated with dating during your divorce is the money you spend on your romantic partner. Your spouse may file a case of dissipation of assets against you.

Dissipation refers to spending money during or nearing a divorce on things that do not concern the marriage or your spouse.

For example, the money you spend to buy gifts for your new romantic partner may be considered dissipation of assets, and you may be required to reimburse the amount.

    • You may lose child custody.

The court focuses on the life of the children and how the divorce affects them. Your new relationship may be harmless, but it could be emotionally damaging to your children, who may still be traumatized by their parent’s separation. If your spouse accuses you of being inconsiderate and careless towards your children, the court may not grant your child custody or reduce visitation rights.

    • Your spouse may accuse you of adulterous behavior.

It is perfectly legal to go on dates with new people and even get into a serious relationship with another person while still waiting for your divorce. However, once your spouse discovers your new relationship, they may accuse you of adulterous behavior or alienation of affection. They might argue that you deserve fewer assets or are not fit as a parent.

These accusations can severely hurt your case. For example, when the court receives these accusations, they may not give you child custody rights because you might not be able to take care of your children due to your relationship.

The list of risks associated with dating during a divorce is endless. It is recommended not to get into a relationship or at least not make it public before the decision is finalized. However, if your spouse already knows about your new partner, an attorney may be able to help.
